Terms and Conditions of Service (BBnB)

Effective: January 24, 2026

Welcome to BBnB (“BBnB”, “we”, “us”). These Terms and Conditions (“Terms”) govern your access to and use of the BBnB platform (the “Platform”), including the website and mobile apps, as a User (either as a Provider or a Customer). By creating an account, listing rental items, booking a service, or otherwise using the Platform, you agree to these Terms (including the Privacy Policy) and to comply with all applicable laws.

BBnB is owned and operated by BBnB GmbH (Swiss company, Katrinenhofpark 5, 8852 Altendorf, Switzerland). The Platform connects registered Providers (rental item providers) with Customers (rental item users) to enable peer-to-peer equipment rentals. BBnB acts only as an intermediary: BBnB does not own, supply, or guarantee any listings or rental items, nor control their truth, accuracy, quality, safety, or legality. Each rental is a contract directly between the Provider and the Customer; BBnB does not become a party to such contracts.

1. Registration and User Accounts

Eligibility

You must be at least 18 years old and have the legal capacity to contract. By registering, you represent that you meet these requirements.

Account Creation

To use the Platform, you must create a BBnB account by providing your full legal name, valid email, and any other requested information. You agree to:

Provide accurate, complete, and current information.
Keep your information up to date.
Register only one account per person (unless BBnB expressly allows more).
Keep your account non-transferable.

Security

You are responsible for your account password and login. You must:

Keep your credentials confidential.
Notify BBnB immediately if you suspect unauthorized use.
Consent to identity verification (e.g., ID check) for fraud prevention and legal compliance.

BBnB is not liable for losses from unauthorized access unless due to our gross negligence.

Account Termination

You may close your account at any time by contacting us, provided you have no pending bookings. BBnB may suspend or terminate your account without notice for violations, fraud, illegal activity, or legal requirements.

2. Listing and Booking

Listings by Providers

Accuracy: When listing a rental item (“Listing”), Providers must accurately describe the item’s condition, availability, restrictions (e.g., age, weight limits), and defects. Photos must be truthful.
Pricing: Providers set the rental price. Prices must include mandatory fees and taxes under Swiss and EU law.
Contract Formation: When a booking request is confirmed, a legally binding Rental Agreement arises directly between Provider and Customer. BBnB transmits the confirmation but is not party to that contract.

Bookings by Customers

Use of Rental Items: A confirmed booking grants a limited lease. Customers must use items only for agreed periods and lawful purposes, follow usage instructions, and return items on time in the received condition (reasonable wear expected).
Booking on Behalf of Others: If booking for someone else, the Customer ensures that person complies with these Terms.

3. Payments, Fees and Taxes

Service Fees

BBnB charges a service fee for each rental (currently approximately 15% of the booking subtotal). This fee is paid by the Customer at booking.

Payment Processing

All payments are processed by Stripe. BBnB does not store full payment details. By providing payment information, you authorize charges for rental and service fees.

Security Deposits

Providers may require a security deposit. This is a separate agreement made directly between the Provider and the Customer. BBnB does not handle, collect, or refund these deposits and assumes no liability for them.

Taxes

All displayed prices include applicable VAT and other taxes under Swiss and EU laws. Providers and Customers are responsible for their own income or profit taxes.

4. Cancellations and Refunds

Customer-Initiated Cancellation

Flexible Policy: Unless a specific policy is displayed on the Listing, Customers may cancel for a full refund (excluding service fees) if cancelled at least 5 days before the rental start date.
Late Cancellation: If cancelled less than 5 days before the start date, the first rental day and service fees are non-refundable; the remainder is refunded.
Exceptions: Refunds for force majeure events are granted at BBnB’s sole discretion upon written request.

Provider-Initiated Cancellation

If a Provider cancels a confirmed booking, the Customer receives a full refund (including service fees). BBnB may impose penalties on Providers for frequent cancellations.

Cancellation Procedure

Submit cancellation or exception requests via the Platform or email support@bbnb.ch. Approved refunds issue to the original payment method within five business days.

5. Use of the Platform; Prohibited Conduct

You may use the Platform only for legitimate rentals. Prohibited activities include:

Violating any applicable law or regulation.
Circumventing BBnB fees or arranging off-platform rentals.
Using bots or automated tools to access the Platform.
Posting fraudulent or misleading content.
Harassing, defrauding, or harming users.

6. Liability and Disclaimers

No Control Over Content: BBnB does not guarantee correctness, condition, or legality of Listings or rental items; all are provided “as is” by the Provider.
Limitation of Liability: To the extent permitted by Swiss and EU law, BBnB is not liable for direct or indirect damages from use of the Platform, Listings, or rentals, except for gross negligence or willful misconduct.
Indemnification: You agree to indemnify BBnB against claims, losses, or expenses arising from your violation of these Terms or applicable laws.

7. Governing Law and Jurisdiction

These Terms are governed by Swiss law. Swiss courts have jurisdiction, though EU/EEA consumers may bring claims in their home jurisdiction where required by law.
